1. Agreement to Terms

By accessing and using Scolemax services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Scolemax services for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Using the materials for any commercial purpose or for any public display
• Attempting to decompile or reverse engineer any software contained on Scolemax services
• Transferring the materials to another person or "mirroring" the materials on any other server
• Removing any copyright or other proprietary notations from the materials

The materials on Scolemax services are provided on an 'as is' basis. Scolemax makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Scolemax does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Internet.

4. Limitations

In no event shall Scolemax or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Scolemax services, even if Scolemax or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on Scolemax services could include technical, typographical, or photographic errors. Scolemax does not warrant that any of the materials on Scolemax services are accurate, complete, or current. Scolemax may make changes to the materials contained on Scolemax services at any time without notice.

6. Links

Scolemax has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Scolemax of the site. Use of any such linked website is at the user's own risk.

7. Modifications

Scolemax may revise these terms of service for Scolemax services at any time without notice. By using this service, you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Kenya, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

9. Prohibited Activities

You agree not to use Scolemax services for any of the following:

• Unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable material
• Circumventing security or authentication measures
• Distributing malware or harmful code
• Phishing or social engineering attacks
• Accessing or using accounts without authorization
• Any activity that violates applicable law or regulations

10. Termination

Scolemax reserves the right to terminate service to any account that violates these terms. Termination may be with or without notice. Upon termination, any content stored with Scolemax may be deleted.

11. Account Inactivity and Deletion

Accounts that remain inactive for more than 30 days without prior communication from the account holder will be subject to deletion. Scolemax will not be held responsible for the loss of any data, files, or account information resulting from account deletion due to inactivity. We recommend maintaining regular contact with our support team or actively using your account to avoid automatic deletion.

12. Account Suspension and Termination

If an account is suspended for any reason and remains suspended for 30 consecutive days, the account will be permanently terminated. This termination will result in:

• Complete loss of access to the control panel
• Permanent deletion of all control panel data
• Irretrievable loss of all associated applications, websites, and files

Scolemax will not be responsible for any data loss or damages resulting from account suspension or termination. Users are strongly advised to regularly back up their data to avoid permanent loss.

13. User Responsibility and Liability Disclaimer

Scolemax shall not be held responsible for how you use your control panel or any applications, websites, or services you build, deploy, or operate through our platform. This includes but is not limited to:

• Fraudulent or scam activities conducted through your applications or websites
• Deceptive, phishing, or malicious emails sent from your account or services
• Gross misconduct toward your customers or users
• Any illegal, unethical, or harmful activities carried out on our infrastructure
• Violation of laws or regulations in your jurisdiction or any jurisdiction where your services operate

You assume full responsibility and liability for all content, activities, and actions performed using your account. Scolemax will not provide support, assistance, or protection for any activities that violate these terms or applicable laws. By using our services, you agree that Scolemax is in no way responsible for consequences arising from your use of the control panel or any applications you develop or deploy. Any violations will result in immediate account suspension and potential legal action.
